Generally, when you return from your FMLA leave, you will either have the same job or a similar job with substantially similar pay and benefits. However, if you’re considered what’s called a key employee, meaning that you’re one of the top 10% of highest paid employees, you may not necessarily get your job back. In some cases, your employer may deny reinstatement if it will cost substantial economic injury to your employer.
