You cannot recover punitive damages against a federal employer. However, you can certainly recover punitive damages against a private employer. Punitive damages are available in particularly severe or reprehensible forms of discrimination, so you have to prove not only that you’ve been discriminated against, but also that your employer acted with malice or reckless disregard for your rights.
